In haar brief aan die Speaker van die Nasionale Vergadering het die Ouditeur-generaal, Tsakani Maluleke gesê: “Die wetgewende sperdatum vir die indiening van MFMA (Wet op Munisipale Finansiële Bestuur 56 van 2003) Finansiële Jaarstate aan die Ouditeur-generaal is 31 Augustus jaarliks. Die OG moet binne drie maande na ontvangs van die state ’n ouditverslag oor daardie state by die rekenpligtige beampte van die munisipaliteit of munisipale entiteit indien.” “Ek wil die Parlement inlig oor die versuim deur die gelyste 17 geouditeerdes om die Finansiële Jaarstate vir oudit in te dien.”
Mulaleke het bevestig dat die Vrystaatse provinsiale wetgewer ingevolge die MFMA in kennis gestel is.
Dit was geen verrassing vir Mafube Business Forum (MBF) dat Mafube Plaaslike Munisipaliteit (MPM) weer ingesluit is onder munisipaliteite wat versuim het om hul finansiële state in te dien. Die duidelike gebrek aan aanspreeklikheid van die Munisipale Bestuurder, die Hoof Finansiële Beampte en raadslede in hul oorsigrol is kommerwekkend, veral terwyl MPM onder verpligte Provinsiale ingryping is. Die opdrag van die Administrateur bepaal dat hy die tydige indiening van die munisipaliteit se finansiële jaarstate volgens die MFMA moet verseker – dus ook 'n ernstige versuim van sy kant af.
Die Ouditeur-generaal het die Speaker versoek om die kwessie rondom die vertraging van die indiening, na die portefeuljekomitees verantwoordelik vir munisipale toesig te verwys, sodat kommer ge-opper kan word oor die vertraagde indiening van finansiële jaarstate, gegewe die belangrikheid van die ouditproses vir toesig en aanspreeklikheid. MBF is van mening dat daar gevolge behoort te wees, vir daardie amptenare wat versuim om regulasies soos bepaal deur die MFMA en Tesourie met betrekking tot die indien van Finansiële Jaarstate, na te kom.

In her letter to the Speaker of the National Assembly, the Auditor-general, Tsakani Maluleke said: “The legislated due date for the submission of MFMA (Municipal Finance Management Act 56 of 2003) Annual Financial Statements to the Auditor-general is 31 August annually. The AG must submit an audit report on those statements to the accounting officer of the municipality or municipal entity within three months of receipt of the statements.” “I would like to inform Parliament of the failure by the listed 17 auditees to submit the Annual Financial Statements for auditing.”
Mulaleke confirmed that the Free State Provincial Legislature has been notified in accordance with the MFMA.
It came as no surprise to Mafube Business Forum (MBF) that Mafube Local Municipality (MLM) is yet again included among municipalities that failed to submit their financial statements. The evident lack of accountability of the Municipal Manager, the Chief Financial Officer, and councillors in their oversight role is troubling, especially while MLM is under mandatory Provincial intervention. The Terms of Reference of the Administrator determines that he is to ensure the timeous submission of the municipality’s Annual Financial Statements as per the MFMA – thus also a serious failure on his part.
The Auditor-general requested the Speaker to refer the submission delays to the portfolio committees responsible for municipal oversight, to raise concerns about the delayed submission of annual financial statements, given the significance of the audit process to oversight and accountability. MBF are of the opinion that there should be consequences for those officials responsible for the non-compliance with the MFMA and Treasury regulations pertaining to the submission of Annual Financial Statements.
